These Terms & Conditions (“Terms”) govern all services provided by Njinga Cycling Limited, a company registered in England and Wales (“Njinga Cycling”, “we”, “us”, “our”).
By purchasing, accessing, or participating in any Njinga Cycling service, you agree to be bound by these Terms. If you do not agree, you must not proceed.
1. Definitions
Website – www.njingacycling.com and associated subdomains
Services – all coaching, training, digital content, subscriptions, events, and Trips
Perform – on-demand digital training and educational content
Accelerate – structured group coaching programmes
Elevate – premium 1:1 or small-group coaching services
Trips – in-person cycling trips, camps, events, or challenges
Digital Content – videos, plans, documents, workshops, and resources
Where service-specific terms apply, they take precedence.
2. Eligibility, Age & Medical Fitness
Our Services are intended for adults aged 18 and over. Participants aged 16–17 may only participate where:
Written parental/guardian consent is provided
Participation is approved by us in advance
A responsible adult accompanies them for Trips
By participating, you confirm that:
You are medically and physically fit
You have sought medical advice where appropriate
You will stop participation if injury or illness occurs
3. Accounts & Access
You are responsible for:
Maintaining confidentiality of login details
All activity under your account
You must not:
Share access
Record, reproduce, or distribute content
Use Services for commercial purposes
4. Payments, Pricing & Subscriptions
4.1 Payments
Payments are processed securely via third-party providers (e.g. Stripe). We do not store full card details. You authorise us to charge your chosen payment method.
4.2 Failed Payments
A 3-day grace period applies. Continued failure may result in suspended or terminated access. Outstanding balances remain payable.
4.3 Subscriptions
Where applicable:
Subscriptions may have a minimum commitment period
Subscriptions auto-renew unless cancelled per instructions
No refunds for partial billing periods
Price changes will be notified with 30 days’ notice
5. Cooling-Off Rights (UK Law)
Digital Content
By requesting immediate access to Digital Content, you acknowledge that you waive your 14-day cooling-off right under the Consumer Contracts Regulations.
Coaching & Programmes
Where programmes have fixed start dates or limited capacity, cancellation rights may be restricted.
Trips
Trips are date-specific services and are exempt from standard cooling-off rights.
6. Refunds & Money-Back Guarantee
Unless expressly stated, all purchases are non-refundable. Where a money-back guarantee is offered, it is subject to reasonable adherence, meaning at minimum:
Attendance at 85%+ of live sessions (where applicable)
Completion of 85%+ of prescribed training
Engagement for the stated minimum programme duration
Refund claims must be submitted within 30 days of purchase to info@njingacycling.com. Our decision is final.
7. Coaching Services (Accelerate & Elevate)
Coaching provides guidance, not supervision or medical advice.
Results are not guaranteed
Coaches may be substituted
Sessions may be rescheduled
Missed sessions are non-refundable unless stated
8. Modification of Services
We reserve the right to make reasonable changes to:
Programme content or curriculum
Coaching schedules or delivery
Coaches or instructors
Trip routes, itineraries, or accommodation
A material change is one that significantly alters the nature of the Service. Where this occurs, reasonable notice will be given and a suitable remedy may be offered at our discretion.
9. Trips & In-Person Events
9.1 Minimum Numbers
Trips require a minimum number of participants. If not met, we may cancel the Trip and issue a full refund.
9.2 Trip Cancellations (Participant)
60+ days before departure: Full refund minus deposit paid at sign up
Less than 60 days: No refund
No refunds for illness, weather, late arrival, or early departure.
9.3 Transfer of Booking
Transfers may be permitted up to 14 days before departure, subject to approval and eligibility. An admin fee may apply.
9.4 Cancellation by Njinga Cycling
If we cancel, you will be offered:
A full refund, or
An alternative Trip or date
We are not responsible for independently booked travel costs.
9.5. Insurance Requirements
You must hold adequate insurance including:
Travel insurance (including cancellation)
Medical and personal accident cover
Emergency evacuation and repatriation
Third-party liability
Cycling-specific insurance covering equipment
Failure to hold insurance may result in refusal to participate without refund.
9.6 Emergency contact Information
You must provide emergency contact details when booking a Trip.
11. Equipment & Safety
For any Njinga Cycling organised event you must ensure:
Your bicycle is roadworthy
You wear an approved helmet while riding
You carry appropriate safety equipment
you follow and obey the highway code
For indoor training, your indoor stationery bike or turbo is set up safely and correctly
We may refuse participation if equipment is unsafe.
12. Media & Photography
We may capture photos or video during Services for marketing purposes. You may opt out by notifying us in writing before or during the event. Opting out does not affect participation. Media is retained only as long as reasonably necessary.
13. Participant Conduct, Safety & Removal
We are committed to providing a safe, respectful, and effective environment for all participants.
We reserve the right, at our sole discretion, to suspend or permanently remove any participant from any Service (including Digital Programmes, Coaching Programmes, community groups, or Trips) where we reasonably believe that the participant:
Acts in a way that is unsafe, reckless, or poses a risk to themselves or others
Fails to follow safety instructions, road laws, or event guidelines
Engages in abusive, harassing, discriminatory, or threatening behaviour
Disrupts the enjoyment or progress of other participants
Spams, solicits, or promotes third-party products or services without permission
Misuses community platforms (including WhatsApp, Facebook, Slack, Zoom, or similar)
Breaches these Terms or any applicable code of conduct
Removal may be immediate where safety or wellbeing is at risk. Where removal occurs due to misconduct, unsafe behaviour, or breach of these Terms, no refund will be due.
Participants must also comply with any community rules or codes of conduct published from time to time.
Nothing in this section affects your statutory consumer rights.
14. Intellectual Property
All content is owned by Njinga Cycling Limited. You are granted a personal, non-transferable licence for personal use only. Unauthorised use may result in termination and legal action.
15. Third-Party Platforms
Use of Services may require compliance with third-party platforms including:
Zenler
Zoom
Vimeo
We are not responsible for third-party outages or restrictions.
16. Limitation of Liability
Participation is at your own risk. To the fullest extent permitted by law:
We exclude liability for indirect or consequential loss.
Our total liability is limited to the amount paid for the relevant Service
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including the right to services performed with reasonable care and skill.
17. Assumption of Risk
Cycling, physical training, and related activities involve inherent risks, including the risk of injury, illness, property damage, and, in rare cases, death. By participating in any Service, you acknowledge and accept these inherent risks and confirm that you choose to participate voluntarily and at your own risk. You agree to follow all safety instructions, act responsibly, and exercise reasonable care for your own health and safety at all times.
18. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Njinga Cycling Limited, its directors, officers, employees, contractors, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
Your breach of these Terms
Your misuse of the Services or Digital Content
Your failure to follow safety instructions or local laws
Any negligent or unlawful act or omission by you
This indemnity does not apply to claims arising directly from our negligence or breach of statutory duty.
19. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control.
20. Complaints & Dispute Resolution
Complaints should be sent to info@njingacycling.com. We aim to:
Acknowledge within 5 working days
Resolve within 14 days where possible
ADR options may be available where disputes cannot be resolved informally.
21. Data Protection
Personal data is processed in accordance with UK GDPR. Please refer to our Privacy Policy for full details.
22. Termination
We may suspend or terminate access for breach of these Terms, without refund.
23. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
24. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction.
